General Terms and Conditions of Sale

Relating to:

Lapa & Pacheco, Lda. and our services and activities. This site is owned by Lapa & Pacheco, Lda., located at Praceta da Castanheira, 88, 4475-019 Maia, Portugal, with VAT number 504531859.

1. APPLICATION

1.1 These General Terms and Conditions apply to all visitors of the Lapa & Pacheco, Lda. website, www.lapapacheco.pt  (hereinafter referred to as the “Site”), and any commercial transactions carried out through the online store on the Site.

Browsing the Site and purchasing any product through it implies acceptance of these General Terms and Conditions by the User and the Customer.

Before ordering any product from our Site, please read these terms carefully and print or save a copy for future reference.

Lapa & Pacheco, Lda. reserves the right to revise and amend these General Terms and Conditions at any time without prior notice, in accordance with Decree-Law 24/2014 of February 17, as amended by Law 47/2014 of July 28.

2. INFORMATION ON CONTENT

Reproduction, transfer, distribution, or storage of content from the Site without prior written authorization for purposes other than strict personal use is prohibited.

Efforts have been made to ensure that the information presented is free of typographical errors. However, if any errors occur, Lapa & Pacheco, Lda. will correct them as soon as possible. Obvious errors, such as pricing, calculation, or typographical errors in offers, promotions, brochures, catalogs, order confirmations, invoices, and other written documents from Lapa & Pacheco, Lda., are not binding.

Product images on the Site are for illustrative purposes only. Customers are advised to review the detailed product description to obtain complete information about product characteristics or request more details if necessary.

3. OFFER AND AGREEMENT

3.1 Offers and promotions on the Site do not imply any obligation. By completing your order, you are making a binding offer to purchase the product(s). All orders are subject to acceptance by Lapa & Pacheco, Lda., and the agreement is only formalized once Lapa & Pacheco, Lda. initiates order fulfillment. If the products are no longer available or out of stock, Lapa & Pacheco, Lda. will inform you and reject the order. If possible, alternative products of a similar nature and quality may be proposed.

3.2 Prices are presented in euros. Product availability is limited to existing stock at the time of the order.

4. DELIVERY COSTS

Delivery charges will be applied to all product orders. Delivery costs cannot be waived. The delivery fee is indicated on the Site.

5. PRICES AND PAYMENT

5.1 The applicable prices are those displayed on the Site, including VAT. Delivery costs and any additional charges are shown separately.

5.2 Payments can be made via:
a) Bank transfer
b) MB Way
c) Multibanco reference
d) VISA

5.3 In certain cases, payment may be restricted to bank transfer only.

5.4 Bank Transfer

After placing your order, you will receive a confirmation email containing Lapa & Pacheco, Lda.'s bank details to proceed with the transfer. Once the transfer is complete, please email info@lapapacheco.pt with proof or confirmation of payment, including the order number. The bank details will be provided at the checkout stage on the website.

Your order will be processed once payment is received, if you choose the bank transfer option.

5.5 Multibanco Reference

After completing the order and selecting this payment method, the necessary payment references will be provided to the customer.

5.6 Order Processing

Orders will be processed once payment confirmation is received, regardless of the chosen payment method.

6. DISCOUNTS

6.1 Promotion periods are indicated on all product pages under "promotion info."

6.2 Promotional discounts are valid only if the order is finalized and paid before the end of the promotion period.

6.3 Saving a product in the cart does not guarantee a discount or price unless the order is completed within the specified period.

7. DELIVERY / COLLECTION

7.1 Lapa & Pacheco, Lda. will make every effort to inform you of the expected delivery dates shortly after the order is completed.

7.2 The delivery period begins on the day the order is confirmed, as outlined in Article 3.1, unless expressly agreed otherwise between the parties.

7.3 If any item is damaged or missing from your order, please contact us at +351 22 606 52 93 or info@lapapacheco.pt within 5 days of delivery. If any product is found to be damaged at the time of delivery, this must be reported to the courier’s representative at the time of receipt. The product will be collected within 5 days from the date the Customer contacts us, unless otherwise agreed.

7.4 Products will be delivered to the location specified in the order. Ownership of the goods passes to the Customer upon full payment of the price and any other applicable amounts. The risk of loss or damage transfers to the Customer at the time of delivery.

7.5 Products will be delivered (by a courier) to the address provided by the Customer. If an order is placed through more than one process, different delivery times may apply.

7.6 Delivery on the Mainland

7.6.1 Deliveries are made between 9:00 a.m. and 6:30 p.m., and it is not possible to specify an exact delivery time. Products will be delivered in person and cannot be left at entrances, porches, or other locations outside the home.

7.7 Delivery to the Islands

7.7.1 Shipments are generally handled by the courier service partnered with Lapa & Pacheco, Lda. Shipping costs are calculated on a case-by-case basis. The Customer will be informed of the cost at the time of order confirmation.

7.8 International Deliveries

7.8.1 All international orders will incur additional shipping costs based on the destination specified by the Customer. These costs are subject to change, and any updates will be communicated to the Customer in advance, if applicable.

8. WARRANTY / CLAIMS

Article 4 of Decree-Law 24/2014 of February 17, as amended by Law 47/2014 of July 28

8.1 The equipment and accessories come with a warranty period established by the manufacturer, which is a minimum of 2 years for end consumers (individuals) and 1 year for professional users, as required by law. This warranty period begins on the date of delivery of the equipment and can only be claimed upon presentation of the warranty certificate and/or the proof of purchase (invoice) duly completed.

8.2 Equipment that exceeds the warranty period established by the manufacturer or by law, or that presents defects resulting from abnormal wear, improper installation, exposure to weather conditions, electrical discharges, negligence, accidents, incorrect handling, moisture or liquid infiltration, use of non-original accessories, or technical interventions performed by unauthorized personnel, will not be covered by the warranty.

8.3 In the event of equipment failure within the warranty period, the User must send the equipment to Lapa & Pacheco, Lda., along with the corresponding proof of purchase and/or warranty certificate. If the Customer chooses alternative return methods, the shipping costs will be borne by the Customer.

9. LIABILITY AND COMPENSATION

9.1 The liability of Lapa & Pacheco, Lda.is limited to the extent permitted by law. Lapa & Pacheco, Lda. will not be held responsible for any damages suffered by the Customer if:

a. The damages result from non-compliance related to the producer's liability, unless Lapa & Pacheco, Lda.is legally liable under the law;

b. The damages are indirect and/or consequential.

9.2 In the event of damage, the Customer is required to mitigate any additional or other damages as much as reasonably possible.

10. RIGHT OF RETURN / CANCELLATION

Articles 4, 10 to 14, and 17 of Decree-Law 24/2014 of February 17, as amended by Law 47/2014 of July 28

10.1 The Customer has the right to terminate the contract within 14 days from the day the Customer, or a third party on their behalf, gains physical possession of the goods, or the last item in the case of multiple goods ordered in a single order and delivered separately. The right of termination may be exercised by notifying Lapa & Pacheco, Lda., at Praceta da Castanheira, 88, 4475-019 Maia, through an unequivocal statement (e.g., a letter sent by mail, fax, or email), sent before the expiration of the 14-day period mentioned above.

Effects of Termination

If the Customer terminates the contract, we will reimburse all payments received, including delivery costs (except for additional costs resulting from the selection of a delivery method other than the least expensive standard delivery option offered by us) without undue delay and, in any case, within 14 days from the date we are informed of the decision to terminate the contract. The refund will be processed using the same payment method used in the initial transaction, unless expressly agreed otherwise, within a maximum of 72 hours. In any case, the Customer will not incur any costs due to the refund. We reserve the right to withhold reimbursement until we have received the returned products or until proof of shipment of the items is provided, whichever comes first.

Return of Goods

If the Customer chooses to exercise the right of termination, they must bear the cost of returning the goods.

Liability and Warranty

The Customer is only responsible for any diminished value of the goods resulting from handling beyond what is necessary to ascertain the nature, characteristics, and functioning of the goods.

10.2 To exercise the right of termination, you may use the model withdrawal form attached to these terms, which is also available on the website. Alternatively, you may terminate the contract by issuing an unequivocal statement to Lapa & Pacheco, Lda., indicating your intention to terminate the contract.

10.3 All products containing consumables (e.g., batteries, chargers) can only be exchanged or returned upon replacement of these consumables. Lapa & Pacheco, Lda. reserves the right to charge or retain the costs for the consumables used by the Customer.

10.4 The right of termination does not apply to:

  • Products made to consumer specifications or clearly customized;
  • Products that deteriorate quickly;
  • Products not suitable for return for health protection or hygiene reasons if the seal has been removed after delivery;
  • Digital content not supplied on a tangible medium if execution began with the prior express consent of the consumer and acknowledgment that the right of withdrawal is lost in such cases;
  • Other consumables not described in clause 10.3, unless defective.
